For Lunio SmartSleep Application

Please read these Terms and Conditions carefully before using the Lunio SmartSleep application (“App” or “Service”). By downloading, installing, or using the App, you (“User”) agree to be bound by these terms without limitation or reservation.

1. Acceptance of Terms

By accessing or using the Lunio SmartSleep App, you confirm that you have read, understood, and accepted these Terms and Conditions. If you do not agree with any part of these Terms, please stop using the App immediately.

2. Nature of Service

Lunio SmartSleep is a free application designed to monitor and analyze sleep quality and provide personalized coaching tips based on sensor data (e.g., microphone, accelerometer) from your device.

• • The App uses on-device processing as the default data processing method.
  • It does not store audio recordings, does not upload data to the cloud, and
  • It is not a medical device and must not be used for medical diagnosis or treatment.

3. Disclaimer of Liability

While we strive to provide accurate, stable, and secure services, we make no warranties regarding:

• • The uninterrupted availability or flawless performance of the App.
  • The accuracy of analysis results (e.g., sleep score, animal persona, tips), which are intended for self-awareness purposes only.
  • Any damages or losses resulting from reliance on information generated by the App.

4. Intellectual Property Rights

• • All intellectual property rights in the App, including trademarks, content, designs, and interfaces, belong to the Company.
  • You may use the App only for personal, non-commercial purposes and may not reproduce, modify, distribute, or exploit any part of the App without prior written consent.

5. Data Privacy

• • Personal data collected or provided through the App will be managed according to our Privacy Policy, which can be accessed at lunio.co.th.
  • You may withdraw consent or delete your personal data as outlined in the Privacy Policy.

6. Acceptable Use

You agree not to use the App in ways that:

• • Violate applicable laws or the rights of others.
  • Involve unauthorized access, hacking, reverse engineering, or misuse of the App.
  • Compromise the stability, security, or integrity of the system or data.

7. Changes to the Terms

We reserve the right to modify or update these Terms and Conditions at any time. Notice will be provided via the App or other appropriate channels at least five (5) business days before the new terms take effect. Continued use of the App after the update means you accept the revised Terms.

8. Termination of Use

We may suspend or terminate your access to the App without prior notice if you violate these Terms or act in a way that harms the App, our system, or other users.

9. Governing Law

These Terms and Conditions are governed by the laws of Thailand. Any disputes arising under these terms will be subject to the jurisdiction of Thai courts.
